Probate, taxes and foreclosure in the Phoenix area

Maricopa County County seat: Phoenix

Probate
Probate is handled by the Maricopa County Superior Court, Probate and Mental Health Department, at the Central Court Building, 201 W. Jefferson St., Phoenix. As of 2026, Arizona law lets heirs use a small estate affidavit for real property if the real estate is worth $300,000 or less after liens, but only six months or more after the death.
Property taxes
The Maricopa County Assessor sets values and the Maricopa County Treasurer bills and collects. You have 60 days from the date the Notice of Value was mailed to file an appeal with the Assessor, and the Limited Property Value used to figure your taxes can rise no more than 5% a year unless the property changes.
Foreclosure and tax sales
Most home foreclosures in Arizona are non-judicial trustee’s sales, held no sooner than the 91st day after the notice of sale is recorded, on a weekday between 9 a.m. and 5 p.m. at the property, a superior court building, or the trustee’s office in the county. Unpaid property taxes are sold as tax liens at the Treasurer’s February sale, and the lien buyer can start a court action to foreclose the right to redeem three years after the sale.

Probate
Probate cases are filed in the Superior Court of Arizona in Pinal County. The same statewide small estate rules apply: as of 2026, a small estate affidavit can transfer real property worth $300,000 or less after liens, filed at least six months after the death.
Property taxes
The Pinal County Assessor values property and the Pinal County Treasurer collects the tax. Under state law, an appeal to the Assessor must be filed within 60 days after the Notice of Valuation was mailed.

The buyer cannot start a court case to foreclose your right to redeem until three years after the sale. That gives you time to pay or to sell the house and clear the lien at closing.

How fast can a foreclosure happen in Arizona?

Most Arizona home loans use a deed of trust, so foreclosure usually happens out of court through a trustee’s sale.
