Probate
Probate matters are handled by the Superior Court of California, County of Santa Clara, Probate Division, with the Probate Clerk’s Office at the Downtown Superior Courthouse in San Jose. As of 2026, California estates under $208,850 can often skip full probate, and a primary residence worth up to $750,000 can pass by a simpler court petition for deaths on or after April 1, 2025.
Property taxes
The Santa Clara County Office of the Assessor sets property values and the county’s Department of Tax and Collections bills and collects. Formal appeals are filed with the Clerk of the Board of Supervisors between July 2 and September 15 each year, an earlier deadline than the November 30 cutoff used in many other California counties.
Foreclosure and tax sales
California foreclosures are usually non-judicial trustee sales. At least three months must pass after the notice of default is recorded, then the trustee must give at least 20 days’ notice of a public auction. If the court granted full authority under the Independent Administration of Estates Act, the sale generally does not need court confirmation, though heirs are usually given a Notice of Proposed Action first. Without full authority, the sale must go back to the probate judge for confirmation, which can add weeks and allow overbidding in court.
