What selling a house in Houston looks like right now
Greater Houston is huge and varied. Close-in neighborhoods like the Heights, Montrose and the Third Ward have older bungalows and cottages, while suburbs from Katy to Kingwood were mostly built in the last 50 years. A lot of the region sits on clay soil that swells and shrinks, so foundation work is a common line on inspection reports. Flooding is the other big issue. Hurricane Harvey flooded homes across the area in 2017, and Texas sellers have to disclose known flooding and flood insurance claims. Many newer subdivisions add municipal utility district (MUD) taxes on top of county, city and school taxes, and insurance costs have climbed. Prices dipped a little over the past year and homes are taking longer to sell. When a house needs a roof, foundation work or flood repairs, some owners decide selling as-is is simpler than fixing it first.

Probate, taxes and foreclosure in the Houston area
Each county runs these a little differently. Here’s what matters when you’re selling an inherited house, dealing with back taxes or trying to stay ahead of a foreclosure. General information, not legal advice.
Harris County County seat: Houston
- Probate
- Probate cases go to Harris County Probate Courts No. 1-5, with filings through the Harris County Clerk. Independent administration is common in Texas, and a small estate affidavit is possible when the estate, not counting the homestead and exempt property, is worth $75,000 or less (as of 2026).
- Property taxes
- Harris Central Appraisal District sets values and the Harris County Tax Assessor-Collector collects county taxes. The protest deadline is May 15 or 30 days after the appraisal notice is delivered, whichever is later. Many neighborhoods also pay MUD taxes.
- Foreclosure and tax sales
- Mortgage foreclosures are usually non-judicial trustee sales held the first Tuesday of the month between 10 a.m. and 4 p.m. (first Wednesday if that Tuesday is January 1 or July 4), after at least 21 days’ notice; in Harris County they are held at the Bayou City Event Center, 9401 Knight Road. Delinquent-tax sales run by the constables are held there too, the same first Tuesday at 10 a.m., and a homestead owner generally has 2 years to redeem after a tax sale.
Fort Bend County County seat: Richmond
- Probate
- Fort Bend County has no stand-alone probate court. Probate cases are heard by the Fort Bend County Courts at Law, with filings through the County Clerk. A small estate affidavit is possible when the estate, not counting the homestead and exempt property, is worth $75,000 or less (as of 2026).
- Property taxes
- Fort Bend Central Appraisal District sets values and the Fort Bend County Tax Assessor/Collector collects. The protest deadline is May 15 or 30 days after the appraisal notice is delivered, whichever is later. Many subdivisions also carry MUD or levee improvement district taxes.
- Foreclosure and tax sales
- Mortgage foreclosures are usually non-judicial trustee sales held the first Tuesday of the month between 10 a.m. and 4 p.m. (first Wednesday if that Tuesday is January 1 or July 4), after at least 21 days’ notice; since December 2025 Fort Bend holds them at the Gus George Law Enforcement Academy, Patton Hall, 1521 Eugene Heimann Circle, Richmond. Constable tax sales are held at the same place on the first Tuesday. A homestead owner generally has 2 years to redeem after the sale, other property 180 days.
Montgomery County County seat: Conroe
- Probate
- Probate cases go to Probate Court No. 1 of Montgomery County, a statutory probate court created from the former County Court at Law No. 2. A small estate affidavit is possible when the estate, not counting the homestead and exempt property, is worth $75,000 or less (as of 2026).
- Property taxes
- Montgomery Central Appraisal District sets values and the Montgomery County Tax Assessor-Collector collects. Tax foreclosure sales are run online by the constables through RealAuction on the first Tuesday at 10 a.m. A homestead owner generally has 2 years to redeem after the sale, other property 180 days.
Brazoria County County seat: Angleton

Locust). Unpaid property taxes lead to a tax suit and a sheriff’s or constable’s sale; a homestead owner generally has 2 years to redeem after the sale, other property 180 days.

What a Houston seller actually walks away with
The list price isn’t what you keep. Here’s an illustrative example for a dated Houston house that needs work. We set the example’s after-repair value a little under the Houston median of about $350,000, since a dated house that needs work is usually a modest, older home.
| List it yourself | Sell to BAM as-is | |
|---|---|---|
| Sale price after repairs | $330,000 | Your offer amount |
| Repairs before listing | −$45,000 | $0 |
| Agent commissions (5.5% assumed) | −$18,200 | $0 |
| Title, escrow, transfer tax and other seller costs (est. 1.5%) | −$5,000 | $0, we pay them |
| Holding costs for 3 to 4 months (est. 1%) | −$3,300 | $0 |
| Inspection repair credits and concessions (est. 1%) | −$3,300 | $0 |
| What you walk away with | $255,200 | Your offer, dollar for dollar |
Illustrative example, not an offer or appraisal. Commissions are negotiable and every house is different. When you list with an agent in Texas, commissions are negotiable, and many sellers have historically paid a combined 5% to 6% to the listing and buyer’s agents. In much of Texas the seller customarily pays for the buyer’s owner’s title policy, whose premium is set by the Texas Department of Insurance, though the standard TREC contract lets the two sides agree otherwise. Texas has no transfer tax, and the state constitution bars one. In Houston-area neighborhoods with MUD taxes, expect prorated MUD and other taxes to show up as a seller credit at closing.
Compare our cash offer to that bottom-line number, not to the list price. If it’s close, you skip the repairs, the showings and months of waiting. If listing will clearly net you more, we’ll tell you.

Selling a house for cash in Houston
Do you buy houses that have flooded?
Yes. We buy houses with past or current flood damage, as-is. You don’t need to repair, remediate or rebuild first. Just tell us what happened and what’s been done so far.
How much time do I have if I’m facing foreclosure in Texas?
Texas foreclosures are usually non-judicial, which means the lender can sell the house without going to court. Sales happen on the first Tuesday of the month, and the timeline after notices go out can be short. Call us as early as you can.
I’m behind on property taxes. Can I still sell?
Yes. Past-due property taxes are paid off from the sale proceeds at closing, along with any mortgage.
Who handles the closing in Houston?
A licensed Texas title company handles the closing. We pay all of your closing costs.
My Houston house flooded before. Do I have to tell a buyer?
In most Texas sales, yes. The Texas seller’s disclosure notice asks whether you know of past flooding, whether the home is in a floodplain, and whether you have filed a flood insurance claim or received federal flood aid. Some sales are exempt, such as certain transfers by an executor during estate administration. A cash buyer who buys as-is still expects to know the history, and being upfront usually keeps a deal from falling apart late.
How fast can a foreclosure happen in Harris County?
Texas foreclosures are usually non-judicial, so they can move fast. For a home you live in, the lender generally has to give you at least 20 days to cure the default, then post a notice of sale at least 21 days before the auction. Sales are held on the first Tuesday of the month at the Bayou City Event Center. Selling before the sale date is one way owners protect their equity.
I inherited a house in Houston. Can I sell it before probate is finished?
You need legal authority to sign the deed. That usually comes from being named independent executor or administrator by a Harris County probate court, or from a muniment of title or a court order that settles who the heirs are. A title company will ask for these papers before closing. Once you have them, you can sell the house as-is, even if the estate is still being wrapped up.
