Probate, taxes and foreclosure in the Las Vegas area
Each county runs these a little differently. Here’s what matters when you’re selling an inherited house, dealing with back taxes or trying to stay ahead of a foreclosure. General information, not legal advice.
Clark County County seat: Las Vegas
- Probate
- Probate and trust matters go through the Clark County Eighth Judicial District Court, Probate Commissioner, at the Phoenix Building, 330 S. 3rd St., Las Vegas. As of 2026, Nevada allows collection by affidavit, without court, for estates with no Nevada real property worth up to $25,000 ($150,000 for a surviving spouse), and summary administration for estates up to $500,000 after encumbrances.
- Property taxes
- The Clark County Assessor sets values and the Clark County Treasurer bills and collects. To challenge a value, you file with the Clark County Board of Equalization by January 15, and Nevada’s tax abatement generally limits yearly increases on an owner-occupied home’s tax bill to 3%.
- Foreclosure and tax sales
- Most Nevada foreclosures are non-judicial: the trustee can sell no sooner than 3 months after recording the notice of default, at a public location in the county between 9 a.m. and 5 p.m., and owner-occupants can request the Foreclosure Mediation Program. For unpaid property taxes, the Treasurer holds the property in trust with a redemption period of about two years, then can sell it at a tax sale.
Nye County County seat: Tonopah
- Probate
- Probate is handled by the Fifth Judicial District Court, which serves Nye and Esmeralda counties. The same statewide rules apply: collection by affidavit for small estates with no Nevada real property, and summary administration for estates up to $500,000 after encumbrances, as of 2026.
- Property taxes
- The Nye County Assessor values property and the Nye County Treasurer collects. Value appeals go to the county board of equalization by January 15, and the 3% cap on tax increases for owner-occupied homes applies here too.
- Foreclosure and tax sales
- Foreclosures follow the same Nevada non-judicial process, with at least 3 months between the notice of default and the sale, and mediation available to owner-occupants. Delinquent tax property is held in trust by the Treasurer for about two years before it can be sold.

I’m behind on my mortgage. Is there anything that slows down a Nevada foreclosure?
